Terms of Service

The agreement governing your use of the Sales Workshop platform.

1. About these terms

1.1. These Terms of Service (the “Terms”) govern access to and use of the Sales Workshop platform, available at https://salesworkshop.ai (the “Service”), operated by Sales Workshop (“we”, “us”).

1.2. By creating an account or using the Service you confirm that you have read these Terms and the Privacy Policy, and that you agree to be bound by them.

1.3. The Service is provided for business use. You confirm you are acting on behalf of a business and that you have authority to bind that business to these Terms.

1.4. If you do not agree with any part of these Terms, you must stop using the Service.

2. What the Service does

2.1. The Service provides AI agents that hold conversations with your leads and customers by voice and text: answering inbound enquiries, making outbound calls, qualifying leads, handling objections from your scripts, booking meetings and recording outcomes.

2.2. The Service includes a web application, an API, integrations with telephony, messengers and CRM systems, analytics and transcripts.

2.3. We may add, change or remove features. We will not materially reduce the core functionality of a paid plan during a paid period without notice.

3. Accounts

3.1. You are responsible for the accuracy of your registration details and for keeping your credentials confidential. Anything done under your account is treated as done by you.

3.2. You must tell us promptly at ai@workaishop.com if you believe your account has been accessed without authorisation.

3.3. You are responsible for the actions of the users you invite to your workspace and for the roles you grant them.

4. Your responsibilities and acceptable use

4.1. You are responsible for the content you load into the Service — price lists, scripts, knowledge base documents and contact lists — and for having the right to use it.

4.2. Consent for contact. You must have a lawful basis for contacting every person you load into the Service. Where local law requires prior express consent for automated or pre-recorded calls, for call recording, or for marketing messages — including the TCPA in the United States, GDPR and national telemarketing rules in the EU and UK, and equivalent rules elsewhere — obtaining and evidencing that consent is your responsibility.

4.3. You must honour opt-outs and do-not-call requests, and must configure the Service so the agent records and respects them.

4.4. You must not use the Service to send unlawful, deceptive, harassing or fraudulent communications; to impersonate another person or organisation; to bypass security or rate limits; to reverse engineer the Service; or to resell access without our written agreement.

4.5. You must not configure an agent to deny being an AI system when a person asks directly.

4.6. You must not load special category data (health, biometric, government identifiers, payment card numbers) into knowledge bases or scripts unless we have agreed it in writing.

5. Third-party integrations

5.1. The Service connects to third-party systems — telephony carriers, messaging platforms, CRM systems, calendars, payment providers. Your use of those systems is governed by their own terms.

5.2. We are not responsible for the availability, accuracy or policy changes of third-party systems. If a provider restricts or withdraws access, the affected functionality may stop working.

5.3. You are responsible for holding the accounts, numbers and API credentials needed for your integrations, and for any charges those providers levy.

6. AI output

6.1. The Service uses large language models. Their output is probabilistic: the agent may occasionally produce an inaccurate or incomplete statement even when configured correctly.

6.2. The agent is configured to answer from your knowledge base. Keeping that knowledge base accurate and current — prices, terms, availability — is your responsibility.

6.3. You should review transcripts and use the handover rules to route sensitive, high-value or unusual conversations to a person. We recommend not relying solely on agent output for statements that are legally binding on you.

7. Intellectual property

7.1. The Service, its software, interfaces, models, documentation and brand are our intellectual property or that of our licensors. Nothing in these Terms transfers ownership to you.

7.2. We grant you a non-exclusive, non-transferable, revocable licence to use the Service for your own business during your subscription.

7.3. You keep all rights in the content you load and in the conversation data your agents generate. You grant us the limited licence needed to host, process and display it in order to provide the Service.

8. Plans, fees and payment

8.1. The Service is provided on paid plans. Current plans, base fees and usage rates are published on the pricing section of https://salesworkshop.ai and are quoted in US dollars unless agreed otherwise in writing.

8.2. Each plan has a monthly base fee plus usage charges for call minutes and messages at the rates published for that plan. Volume is configured inside the plan and billed on actual use.

8.3. Fees are billed in advance for the subscription period and usage charges in arrears. Quarterly billing is offered at a 20% discount on the base fee.

8.4. Fees are exclusive of VAT, sales tax and any other applicable taxes, which are added where required by law.

8.5. If a payment fails we may suspend access after notice. Amounts already paid for a period are non-refundable except where required by law or where we fail to provide the Service.

8.6. We may change prices with at least 30 days’ notice. Changes take effect at your next renewal; you may terminate before then.

8.7. Under the pilot programme, where offered, there is no base fee and no onboarding charge; compensation is a share of confirmed revenue agreed in writing before the pilot starts.

9. Availability and support

9.1. We aim for continuous availability but do not guarantee uninterrupted operation on standard plans. Planned maintenance is announced in advance where practical. Specific uptime commitments are available on Enterprise plans under a separate service level agreement.

9.2. Support is provided by email at ai@workaishop.com during business days, with priority handling on Business and Enterprise plans.

10. Disclaimers and limitation of liability

10.1. The Service is provided “as is”. To the fullest extent permitted by law we disclaim implied warranties of merchantability, fitness for a particular purpose and non-infringement.

10.2. We do not warrant any particular commercial result. Sales outcomes depend on your offer, your market, your traffic quality and your team’s follow-up.

10.3. To the fullest extent permitted by law, neither party is liable for indirect, incidental, special or consequential losses, or for lost profits, revenue or goodwill.

10.4. Our total aggregate liability arising out of or relating to the Service is limited to the fees you paid us in the 12 months before the event giving rise to the claim.

10.5. Nothing in these Terms excludes liability that cannot be excluded by law, including for fraud, wilful misconduct, or death or personal injury caused by negligence.

10.6. You will indemnify us against third-party claims arising from your breach of clause 4, including claims that you contacted people without a lawful basis or without required consent.

11. Confidentiality and data protection

11.1. Each party will keep the other’s non-public commercial and technical information confidential and use it only to perform these Terms.

11.2. Where we process personal data on your behalf we do so as your processor. Our data processing terms, including the Standard Contractual Clauses where applicable, are available on request and form part of these Terms once executed.

12. Term and termination

12.1. These Terms apply for as long as you use the Service. You may terminate at any time by closing your account; termination takes effect at the end of the paid period.

12.2. We may suspend or terminate access immediately if you breach clause 4, if your use threatens the security or lawful operation of the Service, or if required by law. Where practical we give notice and a chance to remedy.

12.3. On termination we make your conversation data available for export for 30 days, after which it is deleted in the ordinary course.

13. Changes to these Terms

13.1. We may update these Terms. The current version is always at https://salesworkshop.ai/terms.

13.2. Material changes are announced in the Service or by email at least 14 days before they take effect. Continuing to use the Service after that date means you accept the new version.

14. Governing law and disputes

14.1. These Terms are governed by the law of the jurisdiction in which Sales Workshop is established, without regard to conflict-of-law rules, and subject to any mandatory consumer or local-law protections that apply to you.

14.2. The parties will attempt to resolve any dispute in good faith within 30 days of written notice before starting proceedings.

14.3. If any provision is held unenforceable, the remainder stays in force.
